Cool Cloud Vapor had marketed its e-liquid product as a supplement and a sports drink. The company’s application for a non-prescription industry distribution label particularly stated that the product could possibly be used as a supplement. It was not designed for use as a sports drink or an athletic supplement, based on the FDA.
When a customer purchased Puff Bar, he or she should have understood that the product was intended for the consumption of candies, not nicotine gum, and that the tastes were added following the manufacturing process.
